Request for Qualifications (RFQ): Real Estate Brokerage Services

The Town of Oak Island, North Carolina (“Town”), is soliciting Statements of Qualifications (SOQs) from qualified, licensed real estate brokerage firms or individuals to provide on-call real estate brokerage and advisory services to support municipal projects and initiatives.

The intent of this RFQ is to identify one or more qualified brokers who can represent the Town in a professional, ethical, and transparent manner for a variety of real estate matters, including but not limited to property acquisition, dispositions, leasing, and strategic real estate advisory services.

Scope of Services

Services may include, but are not limited to:

  • Identification and evaluation of properties for Town use
  • Broker opinion of value (BOVs), market research, and pricing analysis
  • Assistance with purchase, sale, lease, or lease-back transactions
  • Coordination with Town staff and the Town Attorney throughout transactions
  • Supporting due diligence, negotiations, and closings
  • Advisory services related to site selection, assemblage, and redevelopment potential
  • Representation of the Town’s interests in compliance with all applicable laws and ethical standards

The Town anticipates issuing task-specific assignments as needs arise. No minimum volume of work is guaranteed.

Minimum Qualifications

Respondents must meet the following minimum requirements:

  • Active North Carolina real estate broker license in good standing
  • Demonstrated experience providing real estate services to municipal or public-sector clients
  • Familiarity with North Carolina public procurement practices and public agency transactions for real property
  • Ability to comply with all North Carolina Real Estate Commission agency disclosure and representation rules, including dual agency requirements

Agency Disclosure, Ethics, and Conflicts of Interest

The selected firm shall:

  • Comply fully with NCGS Chapter 93A and all NC Real Estate Commission rules
  • Disclose any actual or potential conflicts of interest, including current or recent representation of parties with interests adverse to the Town
  • Obtain prior written consent from the Town for any dual or designated dual agency representation
  • Refrain from using confidential or non-public information obtained through Town representation for personal or third-party gain

Failure to disclose conflicts may result in disqualification or termination of services.

Submission Requirements

Responses shall include the following sections, clearly labeled:

  1. Firm Overview
    1. Legal name, address, and contact information
    2. Description of firm structure and years in operation
  2. Qualifications and Experience
    1. Relevant municipal or public-sector real estate experience
    2. Description of similar projects completed in North Carolina
  3. Key Personnel
    1. Identification of brokers who would work with the Town
    2. Licensure and years of experience
  4. Approach to Municipal Representation
    1. Understanding of ethical obligations when representing public clients
    2. Approach to confidentiality and conflict management
  5. Proposed Compensation Structure
    1. Respondents must clearly describe their proposed compensation structure, including commission rates, flat fees, hourly rates, or any other applicable cost structure.
  6. References
    1. At least three (3) references, preferably public-sector clients
  7. Disclosure Statement
    1. Description of any current or potential conflicts of interest

Selection Process

The Town will evaluate based on:

  • Demonstrated qualifications and relevant experience
  • Knowledge of municipal real estate practices
  • Professional integrity and conflict-management approach
  • Capacity to perform work in a timely and responsive manner

The Town may conduct interviews with one or more respondents prior to selection.

Contract Terms

The selected firms will be required to enter into a professional services agreement with the Town. Compensation structure (commission-based, hourly or task-based) will be negotiated separately and may vary by assignment.

Reservation of Rights

The Town reserves the right to:

  • Reject any or all submissions
  • Request additional information or clarification
  • Cancel or modify this RFQ at any time
  • Select one or multiple firms, or none
